User Agreement
The user agreement herein describes all the terms and conditions with which M3 offers you access to our services. Once you accept the terms and conditions herein, you acknowledge that at anytime we have the right to change or modify the terms and conditions by posting the changes on the M3 website, and you also agree to any modified terms hereunder. You also agree that we have the right to change this agreement as we see fit without prior notice and at anytime without any responsibility or liability to you.
We are a neutral venue. We are not a transportation service provider, broker, or freight forwarder, and as such we do not prequalify or validate anything that transportation service providers make. We are a load board where consumers can post their shipping needs and carriers can then accept those loads. We function solely as a neutral party and we do not provide any endorsements for either the consumer or the transportation service provider. We also cannot and will not guarantee payment from any consumers to any transportation service providers. Because we are not directly involved with the transaction between the consumer and the transportation service provider, we have no control over the accuracy of the listings, the availability of the transportation service providers and we cannot ensure that any shipments will be completed.
Our services are available to anyone who is over the age of 18; if you are under the age of 18, you acknowledge that you have consent from a parent or guardian to use our website, and then only for the services we provide. Members who engage in the transportation of vehicles posted on our website, i.e. transportation service providers, must have a valid operating license for the vehicles they intend to use to transport said vehicles.
You also acknowledge that your provision of services does not confer or imply any contractor or agency with us and that no association or affiliation exists between you and us.
Should any disputes arise between you and any other member of the M3 website, you hereby release M3 and any of its officers, directors or employees from all claims and demands of any nature arising out of the dispute.
As a shipping customer, you are obligated to complete the transaction with the transportation service provider as best you can, unless the transaction itself is illegal in nature. The transportation service provider reserves the right to inspect your shipment before accepting it, and can refuse to transport any item prohibited by either the law or this agreement. We do not qualify or screen transportation service providers for compliance with federal, state or local laws and regulations, so it is recommended that you do your homework before choosing a transportation service provider.
Hazardous or illegal materials are not allowed to be transported – items that pose a danger to health, safety or property while being transported. For details on what exactly is prohibited by law, please visit your local postal regulatory agency or post office. Full responsibility rests with the shipper and not the transportation service provider, and anyone who sends any non-mailable or improperly packaged hazardous materials can and will be subject to legal penalties as defined by law.
All carriers and transportation service providers are required by the Federal Motor Carrier Safety Administration (FMCSA) (part of the U.S. Department of Transportation) to be licensed and registered to carry motorized vehicles across state lines. You can determine the registration and safety statues of your transportation service provider at www.fmcsa.dot.gov. If you are a carrier or transportation service provider, you must be able to transport the shipments you bid on. Common sense people.
M3 reserves the right to terminate your account at any time if we suspect that you have broken the terms of this agreement, and you acknowledge that we are a neutral venue and as such all transactions for services are made between the consumer and the transportation service provider. We are not a part of that.
We reserve the right to keep all records of any and all transactions and communications between you and other members for administration purposes. You shall not solicit to hire nor hire our employees and you shall not interfere with any of our other business relationships including those with our members.
You represent and warrant that you and any individuals that associate with you have never been convicted of a felony. You also represent and warrant that there are no current legal proceedings, whether criminal, civil or administrative, against you that will prevent you from performing your services.
We are not liable for any profits lost or any damages arising out of or in connection with our website, or services or this agreement, including negligence.
Our website contains copyrighted material. You may not use any part of our website for any means, as this constitutes a violation of Intellectual Property statutes. Any content on this website or any other subsidiary websites are the sole property of M3 and cannot be used in any way, shape or form without express written consent.
